These Terms & Conditions ("Terms") apply to your use of Avomeal, including our website, customer dashboard, mobile application, ordering system, subscription services, meal delivery operations, and any related services we provide.

Avomeal is a food service brand, trade name, and operating line of VNV Events LLC, a Florida-based company responsible for the preparation, fulfillment, handling, and distribution of meals and related food services in South Florida.

By placing an order, creating an account, using our mobile app, subscribing to a meal plan, or using any part of our services, you agree to be legally bound by these Terms.

1. Brand Ownership & Legal Entity

Avomeal is not a separate legal entity. It is a commercial brand and food service line operated under VNV Events LLC.

All customer service, food preparation, order fulfillment, delivery coordination, business operations, and legal responsibilities related to Avomeal are managed under VNV Events LLC, including any permits, kitchen operations, and applicable regulatory compliance.

2. Scope of Service

Avomeal provides prepared meals, meal plans, subscription-based meal services, packaged food offerings, delivery and pickup options, and related customer account tools through our website and digital platforms.

We reserve the right to update, change, suspend, or discontinue any menu item, feature, plan, package, delivery area, schedule, or service offering at any time without prior notice.

3. Eligibility & Account Responsibility

You must be at least 18 years old to create an account or place an order. By using our services, you represent that all information provided by you is true, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether through our website or mobile application.

4. Orders & Availability

All orders are subject to acceptance, ingredient availability, operational capacity, delivery coverage, and successful payment processing.

  • Submitting an order does not guarantee acceptance until confirmed by our system.
  • We may reject, limit, delay, cancel, or modify any order at our discretion.
  • Menu items, ingredients, sides, garnishes, and presentation may vary based on availability and production conditions.
  • Product photos and descriptions are for illustrative purposes and may not reflect the exact final presentation.

5. Meal Plans, Memberships & Subscription Billing

Avomeal may offer one-time purchases, recurring meal plans, membership-based ordering, or subscription services, depending on the plan or product selected at checkout.

Subscription Terms

  • By enrolling in a recurring plan, you authorize Avomeal and/or VNV Events LLC to charge your selected payment method according to your active plan.
  • Recurring plans may renew automatically unless paused, skipped, changed, or canceled before the applicable cutoff deadline.
  • Plan pricing, included meals, benefits, and structures may change over time.
  • You are solely responsible for managing your account, billing details, meal selections, pauses, skips, and cancellations before the applicable weekly or recurring cutoff.

If a payment fails, we may pause, delay, reject, or cancel your order or subscription until the issue is resolved.

6. Pricing & Payments

All prices are listed in U.S. Dollars unless otherwise stated. Taxes, service charges, delivery fees, and promotional adjustments may apply at checkout.

  • All sales are final unless otherwise stated in these Terms or required by law.
  • We reserve the right to correct pricing errors, menu inaccuracies, billing issues, or system mistakes at any time.
  • Discounts, coupons, referral incentives, and promotional offers may be modified or discontinued at any time.

7. Delivery, Pickup & Customer Responsibility

Avomeal serves selected delivery areas in South Florida. Delivery windows are estimated time ranges only and are not guaranteed exact delivery times.

Customer Responsibilities

  • You must provide a valid and accurate delivery address, phone number, and any relevant access or drop-off instructions.
  • You are responsible for ensuring safe and reasonable access to the delivery location.
  • If your building, gate, office, concierge, front desk, or access point prevents timely completion of delivery, we may consider the delivery attempt completed once a reasonable effort has been made.

We are not responsible for failed or delayed delivery caused by inaccurate address information, inaccessible locations, security restrictions, lack of response, weather conditions, traffic, road issues, or other circumstances beyond our reasonable control.

8. Delivery Release / Drop-Off Release

If you authorize unattended delivery, door drop-off, lobby drop-off, front desk drop-off, reception delivery, or any designated delivery release method, you accept full responsibility for the order once it has been delivered to the location or instructions you provided.

  • Once an order is marked delivered to the customer-provided address or approved drop-off point, the risk of loss, theft, damage, tampering, temperature change, spoilage, or mishandling transfers to the customer.
  • Photo confirmation, delivery timestamp, driver confirmation, or internal delivery logs may be used as evidence of completed fulfillment.
  • Avomeal and VNV Events LLC are not responsible for unattended meals after successful delivery has been completed.

9. Food Handling, Storage & Consumption Responsibility

Once meals are delivered or picked up, responsibility for proper food handling, refrigeration, reheating, storage, and timely consumption transfers entirely to the customer.

  • Meals should be refrigerated promptly unless otherwise noted.
  • Meals should be reheated and consumed according to reasonable food safety practices.
  • Customers are responsible for ensuring meals are stored at appropriate temperatures and consumed within a reasonable timeframe.

Avomeal and VNV Events LLC are not responsible for food quality, spoilage, contamination, or food safety issues caused by improper handling, delayed refrigeration, improper reheating, third-party interference, or customer negligence after delivery or pickup.

10. Allergy Disclaimer & Ingredient Awareness

While we strive to provide ingredient transparency whenever possible, our meals may be prepared, stored, packaged, or handled in environments where common allergens are present.

These may include, but are not limited to:

  • Milk / Dairy
  • Eggs
  • Fish
  • Shellfish
  • Tree Nuts
  • Peanuts
  • Wheat / Gluten
  • Soy
  • Sesame

We do not guarantee that any product is completely free from allergens, cross-contact, or trace ingredient exposure.

If you or anyone consuming our meals has a food allergy, dietary restriction, medical sensitivity, intolerance, or health-related concern, you are solely responsible for determining whether a product is appropriate before purchase or consumption.

11. Nutrition & Wellness Disclaimer

Any nutritional data, calorie counts, macro estimates, ingredient descriptions, meal labels, or wellness-oriented terms provided by Avomeal—including but not limited to “high protein,” “balanced,” “low carb,” “healthy,” “light,” or similar descriptions—are provided for general informational purposes only.

  • Nutritional values are estimates only and may vary.
  • Ingredient substitutions, preparation methods, and portion sizes may change.
  • Our meals and materials are not intended to diagnose, treat, cure, or prevent any medical condition.

Avomeal does not provide medical advice, dietetic treatment, or individualized nutrition counseling. Customers should consult a licensed physician, dietitian, or qualified healthcare professional before making dietary decisions based on our meals or meal descriptions.

12. Refunds, Cancellations, Credits & Perishable Goods Policy

Because our products are food-based, perishable, time-sensitive, and often made to order or prepared in advance based on customer demand, refunds are limited.

General Policy

  • Orders may not be eligible for cancellation once preparation, packaging, dispatch, or fulfillment has begun.
  • Delivered or picked-up meals are generally non-refundable.
  • Meal plan renewals, subscription charges, or scheduled orders are the customer's responsibility unless modified before the applicable cutoff deadline.

If there is a legitimate issue involving missing items, materially incorrect items, or substantial product quality concerns, customers must report the issue promptly after delivery or pickup.

At our sole discretion, approved issues may be resolved by:

  • Store credit
  • Partial credit
  • Replacement of affected items
  • Refund where legally required or operationally appropriate

We reserve the right to deny refund or credit requests that are abusive, unsupported, inconsistent with our records, fraudulent, or based on conditions outside our control.

13. Chargeback & Payment Dispute Policy

By placing an order, enrolling in a meal plan, or authorizing a recurring payment, you acknowledge that Avomeal products are perishable, operationally committed, and often begin production or fulfillment shortly after purchase.

You agree that you will first contact Avomeal directly to attempt good-faith resolution of any billing, delivery, product, or service concern before initiating a chargeback, reversal, dispute, or claim with your bank or payment provider.

  • Submitting a chargeback for an order that was prepared, delivered, made available for pickup, or otherwise fulfilled may be considered a bad-faith payment dispute.
  • We reserve the right to provide delivery logs, timestamps, communications, order records, production records, customer selections, driver confirmation, photographs, and system records as evidence in response to any payment dispute.
  • Customers who abuse payment disputes or chargeback processes may have their accounts restricted, suspended, or permanently banned from future service.

14. Promotions, Freebies & Limited Offers

From time to time, Avomeal may offer discounts, referral rewards, free add-ons, introductory offers, promotional pricing, or limited-time campaigns.

  • Offers may be modified, paused, or canceled at any time.
  • Offers may be limited by time, availability, quantity, customer status, or service area.
  • Promotions may not be combined unless expressly stated.

15. User Conduct

You agree not to misuse our website, app, ordering system, communications, customer support channels, promotions, payment systems, or staff.

Prohibited conduct includes, but is not limited to:

  • Fraudulent chargebacks or payment disputes
  • False claims about non-delivery or product issues
  • Harassment, threats, abusive language, or defamation directed toward staff
  • Using false information to place orders or create accounts
  • Attempting to exploit discounts, system errors, promotions, or platform vulnerabilities

We reserve the right to refuse service, cancel future orders, suspend accounts, or restrict access for abusive, fraudulent, or harmful conduct.

16. Mobile App, Website & Account Data

Avomeal may allow you to create an account, manage orders, manage subscriptions, review meal selections, and access customer services through our website and/or mobile application.

In order to operate our services, we may collect and process information such as:

  • Name
  • Email address
  • Phone number
  • Delivery address
  • Order history
  • Meal selections and account preferences
  • Technical usage data necessary to operate and secure the platform

This information is used only for legitimate business purposes related to providing our services, such as account management, order fulfillment, customer support, delivery coordination, payment processing, service improvement, fraud prevention, and platform security.

17. Data Privacy & Customer Rights

We respect your privacy.

  • We do not sell your personal data.
  • We do not rent your personal information to third parties.
  • We do not use customer account data for unauthorized commercial resale.

We may use third-party providers such as payment processors, delivery tools, email systems, analytics services, or customer support systems strictly as necessary to operate Avomeal.

Those providers may process limited customer information solely for operational purposes under their own applicable legal obligations and privacy safeguards.

18. Account Deletion & Data Removal

Customers may request to close or delete their account at any time, subject to any legal, operational, accounting, fraud-prevention, payment, tax, or recordkeeping obligations we may be required to retain.

Where available, users may also initiate account deletion directly through their account settings or support channels.

  • Deleting your account may remove access to your order history, account preferences, and saved profile information.
  • Certain transactional, billing, fraud-prevention, tax, or legal compliance records may be retained for a reasonable or legally required period.

19. Transactional Communications

By creating an account or placing an order, you agree to receive essential transactional communications related to your use of Avomeal.

These may include, but are not limited to:

  • Order confirmations
  • Delivery updates
  • Account notifications
  • Password reset emails
  • Subscription or billing notices
  • Service-related support communications

These communications are considered part of the service and may not be fully optional while you maintain an active account or active order relationship with us.

20. Intellectual Property

All Avomeal branding, trademarks, menus, text, recipes, graphics, designs, food concepts, website materials, app materials, and related content are owned by or licensed to VNV Events LLC, unless otherwise stated.

You may not copy, reproduce, distribute, republish, modify, or commercially exploit any part of our content without prior written permission.

21. Third-Party Services

Our platform may use or integrate with third-party providers including payment processors, maps, analytics services, push notification systems, delivery coordination tools, hosting services, and email providers.

We are not responsible for outages, interruptions, failures, delays, or data issues caused by third-party systems outside our reasonable control.

22. Disclaimer of Warranties

Avomeal and all related services are provided on an “as available” and “as is” basis.

To the fullest extent permitted by law, VNV Events LLC disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, uninterrupted availability, accuracy, and non-infringement.

23. Limitation of Liability

To the maximum extent permitted by law, VNV Events LLC, Avomeal, and their owners, officers, employees, contractors, affiliates, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to:

  • Your use of our services
  • Meal selection decisions
  • Food allergy or sensitivity issues where adequate customer review was not performed
  • Delivery timing issues outside our reasonable control
  • Improper food handling after delivery or pickup
  • Loss of convenience, business, profits, opportunity, or data

In all cases, our total liability shall not exceed the amount actually paid by you for the affected order or transaction.

24. Indemnification

You agree to indemnify, defend, and hold harmless VNV Events LLC, Avomeal, and their affiliates, employees, contractors, and representatives from any claims, damages, losses, liabilities, costs, or expenses arising out of:

  • Your misuse of the service
  • Your violation of these Terms
  • Your failure to review ingredients, allergen risks, delivery details, or food handling guidance
  • Your fraudulent or abusive use of our payment, delivery, or customer support systems

25. Force Majeure

We are not responsible for delays, interruptions, cancellations, service failures, or inability to fulfill orders caused by circumstances beyond our reasonable control, including but not limited to weather events, traffic disruptions, road closures, power outages, supplier shortages, labor interruptions, emergencies, acts of God, or government restrictions.

26. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms or your use of Avomeal shall be brought in the appropriate courts located in the State of Florida, unless otherwise required by applicable law.

27. Changes to These Terms

We may update or revise these Terms at any time. Continued use of Avomeal after any update constitutes your acceptance of the revised Terms.
